     The Wellman City Council met in regular session in the Council Chambers of the Wellman Municipal Building at 7:00pm. Mayor Ryan Miller presided with the City Attorney, City Administrator, City Clerk and following Council Members: Richard Oldfield, Robert Goodrich, James Seward, Karri Fisher, and Robert Swartzendruber; absent: no one. Also present were Mary Coblentz from the news media and five citizens.

     Oldfield moved, Swartzendruber seconded and all voted aye to approve the consent agenda to include: the agenda, minutes of the previous meeting, the bill list, Cigarette sales permit renewals for Caseys General Stores and Freeman Foods and the April financial statement.     The Public Hearing to receive comments on the expanded Wellman Urban Renewal Area and the proposed Urban Renewal Plan Amendment was opened at 7:02pm. As there were no comments the hearing was promptly closed. Resolution No. 07-17 to declare necessity and establish an urban renewal area and approve the plan amendment was introduced and caused to be read. Goodrich moved to adopt Resolution No. 07-17, Fisher seconded and upon roll the vote was unanimous ayes. The Mayor affixed his signature.

     Ordinance No 190 to provide for the division of taxes levied on taxable property in the 2007 addition to the Wellman Urban Renewal Area was introduced and caused to be read for the first consideration. Swartzendruber moved for approval of the first reading of Ordinance No. 190. Goodrich seconded the motion and upon roll call the vote was unanimous ayes.

     During the public forum Ryan Redlinger expressed his concerns of his neighbor’s dogs. He is certain they are pit bulls or a mixed breed with pit bulls. They have growled and charged the fence at children and neighbors and habitually bark. He requested the city look into changing the laws for breed specific issues and that something be done with the dogs now present at 701 7th Avenue. The City Attorney recommended calling deputies to deal with demonstrated aggression and barking. The City Administrator will monitor the issue.

      Ordinance No. 189 to amend Chapter 77 to add regulations on small vehicle operation on city streets was introduced and caused to be read for the third reading. Attorney Kitchen reviewed some minor changes in the ordinance to allow for children in need of using motorized wheelchairs. Goodrich moved to approve Ordinance No. 189 for the third reading and final adopt the ordinance as amended. Seward seconded the motion and upon roll call the vote was unanimous ayes. The Mayor affixed his signature.

     Ordinance No. 191 to amend the Zoning Ordinance to allow the City Council to waive building permit fees under certain conditions was introduced and caused to be read. Oldfield moved to approve the first reading of Ordinance No. 191, Swartzendruber seconded and upon roll call the vote was unanimous ayes.

     Resolution No. 07-18 to establish the wage for the new city administrator position was introduced and caused to be read. Swartzendruber moved to adopt Resolution No. 07-18, Oldfield seconded and upon roll call the vote was unanimous ayes. Mayor Miller affixed his signature.

     The pet licensing ordinance was briefly discussed. It was suggested that the fee be waived for the month of July each year. Also, new pets or new residents may license their pets during April, May, and June for the following year. Changes will be presented at the next meeting in ordinance form.

     During the General Administrative discussion Mayor Miller reported cleanup day went well. A small fee was charged this year with about the same amount of residents signing up as in previous years. Swartzendruber suggested we might find a better place than the maintenance shed for the disposal site. South Park was suggested if not too wet.

     With no further business the Council entered into closed session at 7:27pm to discuss matters related to a possible litigation issue. The Council returned to open session at 7:37pm to adjourn the meeting and enter into a work session.

     During the work session, new administrator David Ross, reviewed a list of projects and suggestions for prioritizing. He reported on his first week on the job and various implementations he has made. The work session adjourned at 9:07pm.

     The next regular City Council meeting will be Monday, June 4, 2007, 7:00pm in the Council Chambers of the Wellman Municipal Building.
