FENCE AND HEDGE REGULATIONS

  1. Generally. All fences and hedges are subject to the following location and height restrictions:
  2. No portion of a fence or hedge shall exceed seven feet in height.
  3. Fences and hedges shall be located so no part thereof is within three feet of an alley or three feet of a street right-of-way without City permission.
  4. In residential districts, fences within the front yard shall not exceed five feet in height.
  5. Before issuing a permit for a fence proposed to be located on a lot line that is shared by two different property owners, the City shall require the following conditions to be met:

  • The owners of the properties that share the lot line on which the proposed fence will be located must sign a written agreement that outlines the material from which the fence will be constructed, the location of the fence, the height of the fence, and the agreement of both property owners to all of the above conditions.
  • The agreement must then be filed with the CountyRecorder.
  • A copy of the agreement and proof of its filing with the CountyRecorder must be presented to the City Official responsible for the issuing of fence permits before the permit will be issued.
  • If agreement cannot be reached between the property owners on a shared lot line fence, any fence constructed on either property must be a minimum of three feet from said shared lot line.
 
  1. In residential districts, fences or hedges within the front yard shall not exceed five feet in height.
  2. Fences must be placed so that they do not interfere with pedestrian or vehicular traffic and their safety and sight distances and if in violation of this requirement they shall be subject to removal.
  3. No fence shall interfere with pedestrian or vehicular traffic, including safety and site distance concerns if a fence violates this provisions, it shall be removed at the owner’s expense.
  4. Swimming Pools. Fenced enclosures shall be provided for outdoor, in-ground swimming pools with a depth of 18 inches or more, and shall be subject to the following requirements:
  5. Fences must be at least four feet in height from ground level but shall not to exceed seven feet from the top rim of the pool, and have no spaces that would allow a four-inch diameter sphere to pass through.
  6. Fences must have a self-closing and self-latching device on the gate.
  7. Fences must be located so no part thereof is within three feet of an alley or three feet of a street right-of-way.
  8. Barbed Wire and Electric Fences. Barbed wire and electric fences are subject to the following requirements:
  9. Barbed wire and electric fences shall not be allowed in residential or commercial zones.
  10. Barbed wire and electric fences shall be prohibited within five feet of a public sidewalk or within four feet of a street right-of-way where a public sidewalk does not exist.
  11. Electric fences shall not be permitted in any district except for the enclosure of livestock operations in Agricultural Districts (A-1).
  12. No electric fence shall carry a charge greater than 25 milliamperes or a pulsating current longer than one-tenth (1/10) per second in a one-second cycle. All electric fence chargers shall carry the seal of an approved testing laboratory.
