The Wellman City Council met in regular session in the Council Chambers of the Wellman Municipal Building at 7:00pm. Mayor Ryan Miller presided with the City Attorney, City Administrator, City Clerk and following Council Members: Robert Goodrich, Marc Pennington, Steve Slaubaugh, Matt Latcham and Fern Bontrager; absent: no one. Also present were: Mary Coblentz from the news media, and four citizens and/or guests. The consent Agenda was approved upon motion by Slaubaugh, second by Pennington and all aye votes. The consent Agenda includes the agenda, minutes of the previous meeting, Freeman Cigarette Sales Permit, Casey’s General Stores Beer Sales Permit, City of Wellman Outdoor Beer Sales Permit (for the June 27 street dance) and the following claims:

At 7:06pm Bontrager moved to enter into closed session pursuant to Iowa Code section 21.5(1)(i) to evaluate the professional competency of an individual whose appointment, hiring, performance, or discharge is being considered when necessary to prevent needless and irreparable injury to that individual’s reputation and that individual requests a closed session. Pennington seconded and all voted aye. At 7:25pm Goodrich moved to return to open session, Slaubaugh seconded and all voted aye.

Resolution No. 09-21 to set a date for a public hearing to meet requirements for a state SRF loan application for the proposed city-wide reverse osmosis treatment project was introduced and caused to be read. The hearing date is set for July 20, 2009 at 7:00pm. Goodrich moved to adopt Resolution No. 09-21, Slaubaugh seconded and upon roll call the vote was unanimous ayes.

Resolution No. 09-22 to approve a plat within the two mile fringe area of the City of Wellman for the Runicman development was introduced and caused to be read. Slaubaugh moved to adopt Resolution No. 09-22, Latcham seconded and upon roll call the vote was unanimous ayes.

Resolution No. 09-23 to set fiscal year 2010 employee wages was introduced and caused to be read. Bontrager moved to adopt Resolution No. 09-23, Slaubaugh seconded and upon roll call the vote was unanimous ayes.

Ross explained storm water drainage issues on Circle Drive. The Council had approved a drainage tile installation across the Buckwalter property which brings water down from 7th Avenue and 11th Street. The tile empties into the street causing constant wet and silty conditions on the street. Ross had the city engineer look at possible solutions. The cheapest repair would involve extension of the storm sewer and hookup the tile directly into it for a cost of approximately $4800. Ross plans to use road use tax and local option sales tax funds to cover the costs. Goodrich moved to approve the project, Latcham seconded and all voted aye.

During the Public Forum Tom Buckwalter asked about the Miller Pond property owned by Stuart Yoder and under Council order to be cleaned up. He understood there would be a status report tonight from Yoder but he was not present. Buckwalter had received a couple calls from residents near the property concerned that Yoder was now burning the tree waste causing smoke and cinders. It was pointed out burning yardwaste is allowable by City Ordinance but burning of trees as a result of construction or grubbing is not allowed. Yoder will be informed of this. Buckwalter also reported that a meeting with the general contractors for the Parkside Activity Center resulted in approval to do limited tours of the facility on July 4th. This will give citizens a sense of what the space will be like when the building is done. Details have not yet been worked out but announcements will be made as soon as the information is available.

In General Administrative discussion Goodrich commented on the need to wash the streets down and clean up of broken glass at a building on 2nd Street and 8th Avenue. He also complained of numerous cat droppings in his yard and a report of numerous cats running loose in the City. Goodrich asked that a project get started to capture the cats and find a volunteer to take them to the Washington shelter.

Following a brief discussion Goodrich moved for adjournment at 7:47pm, Latcham seconded and all voted aye. The next regular City Council meeting will be Monday, July 6, 2009, 7:00pm in the Council Chambers of the Wellman Municipal Building.
